Terms of use

Using Maya means accepting these terms. They are written to be read: the most important point comes first.

Maya is a collection of tips posted by its users, not an authoritative source. The recipes have undergone no scientific, food-safety, veterinary or regulatory validation. They involve food, household products, animals and plants: applied wrongly, some can poison, burn, damage property or harm an animal. You carry them out at your sole risk, having read the cautions and used your own judgement. This English text is provided for convenience. The French version of this document is the only legally binding one, and prevails in the event of any discrepancy.

Article 1 — Purpose

These terms of use (the “Terms”) govern access to and use of the Maya service, available at maya.subalpine.it (the “Service”), published by Jérôme Buisine, a sole trader (the “Publisher”), whose details appear in the legal notice.

Accessing the Service constitutes full acceptance of these Terms. If you do not accept them, do not use the Service.

Article 2 — Description of the Service

The Service is a collaborative collection of so-called “zero-waste” recipes, searchable by the waste you have or by the use you are looking for, across four categories: household, food, animals and garden.

The Service is provided free of charge, with no financial consideration of any kind. It is a tool for information and mutual help between private individuals.

It does not constitute medical, nutritional, veterinary, agronomic, chemical or legal advice, nor any professional recommendation. It is no substitute for the opinion of a doctor, a vet or a qualified professional, nor for the instructions, labelling and safety data sheets of the products you use.

Article 3 — Nature of the content and absence of warranty

Recipes are posted by users. The Publisher does not exhaustively verify their accuracy and is not in a position to do so: domestic practices are countless, ingredients vary, and outcomes depend on conditions the Service knows nothing about.

Accordingly, the Publisher warrants none of the following:

  • the accuracy, completeness or currency of the recipes, quantities, durations and cautions displayed;
  • the harmlessness of any preparation, mixture or ingredient, for a person, an animal, a plant or an item of property;
  • the absence of allergic reaction, intolerance or interaction: no list of allergens is compiled or maintained;
  • the edibility or wholesomeness of a food preparation, which depend on the freshness of the ingredients, on hygiene and on storage conditions that are yours alone;
  • the absence of damage to the surfaces, materials, appliances, textiles or plumbing a preparation is used on;
  • the compliance of any practice with applicable regulations, notably regarding home-made plant preparations, animal feed or waste disposal;
  • the absence of interruption, delay or error in the operation of the Service.

Article 4 — The Service is provided “as is”

The Service and its content are provided “as is” and “as available”, without warranty of any kind, express or implied, to the extent permitted by applicable law — including, without limitation, any warranty of fitness for a particular purpose, satisfactory quality or result.

Ratings, averages and rankings reflect the opinion of the users who left them. They are neither a certification nor a guarantee of safety: a highly rated recipe may still be dangerous for you, your animal or your home.

Article 5 — User responsibility

You remain solely responsible for your decisions, your actions and their consequences. Before carrying anything out, it is for you:

  • to read the cautions shown on the page, which appear before the steps and not after;
  • to check that the ingredients and products used are fit for the intended purpose, and to observe their labelling, instructions and hazard pictograms;
  • never to mix household products without knowing what the mixture produces — bleach releases a toxic gas on contact with an acid such as vinegar, or with an ammonia-based product;
  • to observe basic food hygiene: freshness, cleanliness, the cold chain, and safe temperatures and storage times;
  • to check with a vet that a preparation suits the animal concerned — its species, breed, age and state of health — before giving it or leaving it within reach;
  • to take account of the allergies, intolerances, medical treatments, pregnancies and conditions of the people concerned;
  • to supervise children and animals, and to keep preparations, products and utensils out of their reach;
  • to comply with applicable regulations, notably on safety, waste and the treatment of plants.

Article 6 — Limitation of liability

To the extent permitted by applicable law, the Publisher shall not be liable for any damage arising from use of the Service or from reliance on the content it presents, including:

  • poisoning, allergy, burns, irritation or any other harm to a person’s health;
  • harm to the health of an animal, or its death;
  • damage to property, a surface, an appliance, a textile, a crop or an installation;
  • the failure of a preparation, the loss of the ingredients used or the time spent;
  • any indirect loss, loss of business, of opportunity or of data.

Article 7 — What nothing here limits

Nothing in these Terms excludes or limits the Publisher’s liability for gross negligence or wilful misconduct, for personal injury attributable to it, or in any other case where the law forbids it.

These Terms do not affect the rights granted to consumers by law.

Article 8 — User account

Reading is open and requires no account. Contributing requires an account, created by entering an email address to which a single-use code is sent. There is no password.

You undertake to provide an email address you own, not to impersonate anyone, and to keep the codes you receive confidential. The Service is not intended for children under fifteen without the consent of their legal guardian.

You may change your display name, change the interface language and delete your account at any time from the “Your account” screen.

Article 9 — Contributions

You warrant that your contributions are accurate to the best of your knowledge, that you wrote them yourself or hold the rights needed to publish them, and that they infringe no third-party rights. Copying text from another site, a book or a magazine is prohibited, even with attribution.

You undertake to state every relevant caution in the field provided for that purpose, particularly where a recipe involves a heat source, a household product, an allergenic ingredient, or feeding an animal.

By posting a contribution you grant the Publisher a non-exclusive, royalty-free, worldwide licence, for the duration of the rights, to reproduce, adapt, translate, correct and distribute it as part of the Service and its promotion. The sole purpose of this licence is to allow the Service to operate.

Deleting your account does not delete your recipes: other users rely on them and have rated them. The link to your account is however severed and the contribution becomes anonymous. If you want a recipe gone, delete it before closing your account.

Article 10 — Acceptable use

The following are prohibited:

  • posting a dangerous recipe, or withholding a caution you are aware of;
  • posting knowingly false, misleading or defamatory information;
  • publishing insulting, hateful or discriminatory content, or content that invades the privacy of others;
  • using the Service for promotional or advertising purposes;
  • manipulating ratings or creating multiple accounts to influence a recipe’s ranking;
  • extracting the Service’s data at scale by automated means, or circumventing the rate limits in place;
  • disrupting the operation of the Service or compromising its security.

Article 11 — Moderation

The Publisher may, without notice and without compensation, refuse, correct, unpublish or delete any contribution that breaches these Terms or whose safety cannot be established, and may suspend or close an account in the event of a breach.

A recipe that the community establishes statistically to be bad is archived: it drops out of search results while remaining readable by direct link, and returns on its own if later reviews are better. Archiving is a quality measure, not a sanction.

Dangerous content is removed without waiting for any rating threshold. You may challenge a moderation decision by writing to contact@subalpine.it.

Article 12 — Reporting unlawful content

In respect of contributions, the Publisher acts as a hosting provider within the meaning of article 6-I-2 of French law no. 2004-575 of 21 June 2004 on confidence in the digital economy.

Any content believed to be unlawful, dangerous or inaccurate may be reported from the page concerned, or by email to contact@subalpine.it stating the address of the page, a description of the content and the grounds for the request. Manifestly unlawful content is removed promptly after notification.

Article 13 — Availability of the Service

As the Service is free, the Publisher gives no availability undertaking. It may interrupt, modify or discontinue the Service at any time, notably for maintenance, without this giving rise to any compensation. Where possible, a lasting interruption is announced in advance.

Article 14 — Personal data

The processing carried out, its purposes, retention periods and the ways to exercise your rights are described in the privacy policy, which forms an integral part of these Terms.

Article 15 — Changes to these Terms

These Terms may be amended to reflect changes to the Service or to the law. The applicable version is the one published on this page, whose effective date appears at the foot of the document. Continuing to use the Service after publication constitutes acceptance of the version in force.

Article 16 — Governing law and disputes

These Terms are governed by French law. In the event of a difficulty, please first make contact at contact@subalpine.it so that an amicable solution can be sought.

Failing agreement, and on an optional basis, a consumer may turn to a consumer ombudsman or to the European online dispute resolution platform. Failing an amicable resolution, the dispute shall be brought before the competent French courts. If you are a consumer, you retain the right to bring proceedings before the courts of your place of residence.
